The Software is intended to assist with driver management. It does not replace the user's responsibility to maintain appropriate backups of important files and to understand the condition and configuration of their computer.

Software features may depend on the version of the Software, Windows configuration, available driver sources, hardware, and other technical conditions.

3. Eligibility

You must have the legal capacity to enter into these Terms under the laws applicable to you.

If you purchase or use the Software on behalf of a business or other organization, you represent that you have authority to accept these Terms on that organization's behalf.

You are responsible for ensuring that your use of the Software complies with applicable laws and regulations.

  • Use our trademarks, branding, or other intellectual property in a way that suggests an unauthorized affiliation or endorsement.

We may restrict or suspend access to the Website where reasonably necessary to protect the Website, our users, our systems, or our intellectual property.

5. Software Purchase

SERBESA Driver Care is currently offered for a one-time purchase price of $19.99.

The purchase price is for the applicable Software license and does not constitute a subscription or recurring billing arrangement.

Unless expressly stated otherwise at checkout, purchasing the Software does not create an automatic subscription or recurring payment obligation.

Applicable taxes or other charges, if any, will be presented during the purchase process where required.

The final amount payable will be presented before you complete your purchase. Businesses selling online should make material price and fee information clear before payment.

Additional terms presented by the payment provider may also apply to the payment transaction.

SERBESA Driver Care is delivered electronically.

After a successful purchase, the applicable product license key and Software download or setup information are sent to the email address provided during checkout.

Email-Only Delivery

For security and authenticity purposes, SERBESA distributes the Software through authorized electronic delivery channels.

We strongly recommend obtaining the Software only through the official SERBESA website and authorized delivery process.

Do not download purported SERBESA Driver Care installers or license keys from unofficial download websites, file-sharing services, forums, pop-up advertisements, or other third-party sources.

Unofficial copies may be modified, outdated, incomplete, or potentially harmful.

If you believe you did not receive your license information or download instructions after completing a purchase, contact us at: support@serbesasoftware.com

8. License and Software Use

Your purchase of SERBESA Driver Care does not transfer ownership of the Software to you.

Subject to these Terms and the SERBESA Driver Care EULA, SERBESA grants you a limited, personal, non-exclusive, non-transferable license to use the Software for its intended purpose.

The Software may be used only in accordance with the EULA and these Terms.

The EULA contains additional provisions concerning:

  • License rights
  • Software installation
  • Activation
  • Permitted use
  • License restrictions
  • Reverse engineering
  • Redistribution
  • System modifications
  • Driver updates
  • Backups and restoration
  • Third-party drivers
  • Software ownership
  • Warranty disclaimers
  • Liability limitations

If there is a conflict between these Terms and the EULA regarding the specific licensing and use of the Software, the EULA will control to the extent of that conflict.

9. Prohibited Software Activities

Unless expressly permitted by applicable law, you may not:

  • Reverse engineer the Software.
  • Decompile or disassemble the Software.
  • Attempt to derive its source code.
  • Modify or create derivative works from the Software.
  • Circumvent or disable license activation mechanisms.
  • Remove proprietary notices or copyright notices.
  • Resell, lease, rent, sublicense, or commercially distribute the Software.

  • Use the Software to facilitate unlawful activity.

Nothing in these Terms is intended to restrict rights that cannot legally be restricted under applicable law.

10. Driver Updates and Third-Party Components

SERBESA Driver Care may identify and facilitate access to driver updates originating from third-party hardware manufacturers and technology providers.

These may include manufacturers such as:

  • NVIDIA
  • Intel
  • AMD
  • Realtek
  • HP
  • Dell
  • Lenovo
  • ASUS
  • Logitech
  • Canon

This list is illustrative and does not represent an exhaustive list of manufacturers or a claim of affiliation with any of them.

SERBESA does not manufacture the hardware associated with these third-party drivers and does not necessarily create the underlying driver packages.

Third-party drivers remain subject to the applicable manufacturer's technology, compatibility requirements, terms, and limitations.

11. No Affiliation or Endorsement

SERBESA SOFTWARE LLC is an independent software publisher.

SERBESA is not affiliated with, endorsed by, sponsored by, or otherwise officially associated with Microsoft Corporation or the third-party hardware manufacturers and technology companies referenced on our Website or in our Software materials unless we expressly state otherwise.

Microsoft, NVIDIA, Intel, AMD, Realtek, HP, Dell, Lenovo, ASUS, Logitech, Canon, and other third-party names and trademarks belong to their respective owners.

References to third-party products, manufacturers, technologies, or trademarks are provided for identification and compatibility purposes and do not imply endorsement, sponsorship, or affiliation.

12. System Changes and User Responsibility

SERBESA Driver Care is designed to perform certain system-maintenance operations that may affect your Windows installation.

Depending on the Software's applicable features and your system configuration, these operations may include:

  • Reading hardware and device identifiers.
  • Identifying installed driver versions.
  • Downloading driver packages.
  • Creating driver backups.
  • Creating Windows System Restore points.
  • Replacing or updating driver files.
  • Creating scheduled tasks for supported background or quiet scanning functions.

Because driver installation and system configuration can affect computer operation, you should maintain independent backups of important personal files before performing significant system changes.

A driver backup or Windows System Restore point should not be treated as a substitute for maintaining independent backups of your important documents, photographs, business files, or other personal data.

You remain responsible for the condition and configuration of your computer and for maintaining appropriate backups.

13. Compatibility and Performance

SERBESA Driver Care is designed to support Windows operating systems, including:

  • Windows 11
  • Windows 10
  • Windows 8
  • Windows 7

Supported environments may include both 32-bit and 64-bit systems.

Actual compatibility and Software performance may vary depending on factors including:

  • Hardware configuration
  • Device condition
  • Existing driver state
  • Windows version
  • Windows configuration
  • Available driver packages
  • Manufacturer-specific requirements
  • Conflicts with other software
  • System permissions
  • Network availability

We do not guarantee that every driver, device, hardware configuration, or Windows installation will be fully compatible with every Software function.

14. No Guarantee of Driver Results

The Software is intended to assist with driver management. However, driver-update results depend on the individual computer and its configuration.

SERBESA does not guarantee that:

  • Every available driver will be identified.
  • Every driver update will be available.
  • Every driver will install successfully.
  • A particular driver version will be the best option for every system.
  • An update will resolve a particular hardware or software problem.
  • A driver installation will improve system performance.
  • The Software will identify every possible driver-related issue.
  • A particular computer will remain error-free after a driver change.

Driver behavior may depend on the hardware manufacturer's software, Windows configuration, device condition, and other factors outside SERBESA's control.

15. Independent Backups

Before making significant changes to your system, you should maintain current backups of important personal and business data.

Although SERBESA Driver Care may provide driver backup and restoration functionality, those features are intended specifically for supported driver-management purposes.

They should not be treated as a complete backup solution for your personal files.

SERBESA is not responsible for loss of personal files that results from your failure to maintain appropriate independent backups.

16. Technical Support

Customer support is provided primarily through email at: support@serbesasoftware.com

When requesting assistance, you may be asked to provide information reasonably necessary to investigate your issue, such as:

  • Order information
  • Software version
  • Windows version
  • Hardware information
  • Driver information
  • Error messages
  • Relevant technical details

We may use information you voluntarily provide to investigate support requests, process refunds, and communicate with you about your purchase or Software.

Additional information about personal-data handling is described in our Privacy Policy.

17. Intellectual Property

The Website, Software, branding, logos, text, graphics, documentation, designs, and other materials provided by SERBESA are owned by or licensed to SERBESA SOFTWARE LLC unless otherwise stated.

These materials are protected by applicable intellectual-property laws.

Except for the limited rights expressly granted under these Terms or the EULA, no ownership rights are transferred to you.

You may not reproduce, distribute, modify, publish, sell, license, or commercially exploit SERBESA intellectual property without our prior written permission, except where applicable law expressly permits such use.

18. Third-Party Services and Links

The Website or Software may interact with or reference third-party technologies, websites, services, driver repositories, manufacturers, or other resources.

Third-party services are controlled by their respective providers.

SERBESA does not control and is not responsible for:

  • Third-party websites
  • Third-party terms
  • Third-party privacy practices
  • Third-party service availability
  • Third-party driver content
  • Third-party software
  • Changes made by third-party providers

Your use of third-party services may be subject to separate terms and privacy policies.

19. Privacy

Your privacy is important to us.

Our Privacy Policy explains what information SERBESA may collect, how information may be used, how third-party service providers may process information, and what rights may be available to you.

The Software may locally access hardware specifications and driver-version information for purposes associated with identifying compatible driver updates.

For additional information about data handling, please review our Privacy Policy.

20. Cookies and Website Technologies

Our Website may use cookies, analytics technologies, tags, and similar technologies to operate the Website, understand Website usage, and improve our services.

Where applicable, our Cookie Policy explains the types of technologies used and how you can manage your preferences.

21. Refunds

SERBESA offers a 30-day money-back guarantee for eligible purchases.

Refund requests should be submitted to: support@serbesasoftware.com

You should make the request using the email address associated with your purchase or provide sufficient order information for us to identify the transaction.

Eligible refunds are generally returned to the original payment method through the applicable payment provider.

Additional conditions and procedures are described in our Refund Policy.

The refund terms presented to customers should remain clear and consistent across the Website, checkout process, and applicable policy. Clear refund disclosures are an important part of online consumer transactions.

22. Chargebacks and Payment Disputes

If you believe a payment was processed incorrectly, please contact us at support@serbesasoftware.com so that we can investigate the issue.

Nothing in these Terms is intended to prevent you from exercising rights available to you under applicable payment-card rules or consumer-protection laws.

Where appropriate, we may provide transaction and order information to the relevant payment provider to investigate a payment dispute.

23. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Website and Software are provided on an "AS IS" and "AS AVAILABLE" basis.

To the extent permitted by law, SERBESA disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

  • The Website will always be available.

  • Hardware problems
  • Software conflicts
  • Driver-related issues

To the maximum extent permitted by applicable law, SERBESA's total aggregate liability arising from or relating to the Software, Website, or these Terms will not exceed the amount you actually paid to SERBESA for the Software giving rise to the claim.

For the current standard purchase price, this amount is $19.99.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

25. User Responsibility

You are responsible for:

  • Using the Software in accordance with these Terms and the EULA.
  • Maintaining appropriate backups.
  • Providing accurate purchase and contact information.
  • Protecting your license key.
  • Using the Software only on systems you are authorized to manage.

You should not use the Software on a computer or system unless you have the necessary authorization to perform the relevant maintenance activities.

26. Suspension and Termination

We may suspend or terminate your access to the Website or terminate your Software license where permitted by law if you materially breach these Terms or the EULA.

Examples may include:

  • Unauthorized redistribution of the Software
  • License-key sharing

27. Changes to the Website or Software

We may modify, update, improve, suspend, or discontinue portions of the Website or Software from time to time.

29. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce that provision later.

Any waiver must be understood in the context in which it is given and does not automatically constitute a continuing waiver.

30. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, where legally permissible.

The remaining provisions will continue in effect.

31. Entire Agreement

These Terms, together with the EULA, Privacy Policy, Refund Policy, Cookie Policy, and any other documents expressly incorporated into these Terms, constitute the agreement between you and SERBESA regarding the subject matter covered by those documents.

They supersede prior communications or understandings concerning the same subject matter to the extent permitted by law.

32. Governing Law

These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

33. Dispute Resolution and Jurisdiction

The parties will first attempt to resolve disputes through good-faith communication.

If you have a dispute or concern relating to the Website, Software, purchase, or these Terms, please contact: support@serbesasoftware.com

If the dispute cannot be resolved informally, the dispute may be brought before the courts having appropriate jurisdiction in Las Vegas, Nevada, subject to any mandatory rights or protections available to you under applicable law.

Nothing in this section prevents a consumer from exercising a non-waivable legal right available in the jurisdiction where the consumer resides.

34. Consumer Rights

Nothing in these Terms is intended to remove, restrict, or waive rights that cannot legally be excluded under applicable consumer-protection laws.

If a provision of these Terms conflicts with a mandatory consumer-protection requirement applicable to you, the mandatory requirement will prevail to the extent of the conflict.
